ConWISE GmbH (“ConWISE”, “we”, “us”) offers a platform for digital consulting services (hereinafter also referred to as “application” or “platform”). This also includes the websites ConWISE.de and ConWISE.ai.

While you use the platform, ConWISE collects and processes information from and about you in order to provide you with access to the application, to improve your experience using the platform and to interact with you. This privacy policy (the “Privacy Policy”) describes how ConWISE collects, uses and shares information collected through the Application and the choices you have regarding that information.

1. User Types

ConWISE differentiates between three different types of users:

  • We refer to users who use the application as part of a paid ConWISE subscription as “ users ”. The services, features and functions available to users depend on the type of paid subscription. These are subject to specific conditions according to a separate agreement concluded between ConWISE and the organization (e.g. your employer or another legal or natural person, referred to as “customer”) to regulate the provision, access to and use of the application (the “Customer Agreement “). The customer in turn controls the information and is the data controller of the information entered by the users via the platform. ConWISE processes the information on behalf of the customer.
  • Users who use a free version of the ConWISE platform are ” trial users “. Trial users can access and use the application, however their access to platform features and functions is more limited than users. ConWISE is the data controller for the information collected via the Platform on Probe Users.
  • Users of the websites are referred to as ” website visitors “. Website visitors can be individuals who simply visit the websites but do not use the actual ConWISE platform; However, website visitors can also be trial users or users who visit the websites to obtain additional information about ConWISE. ConWISE is the data controller for the information collected about website visitors via the website.

2. Privacy Policy for Users and Trial Users

2.1. Preliminary remark

If you are a user , the “Customer Agreement” governs the collection and processing of information through the platform. For the most part, information is generated through participation in “Sessions,” including all related messages, attachments, files, tasks, and other content submitted through the Platform (“Session Content”). In the event of any conflict between this Privacy Policy and the Customer Agreement, the Customer Agreement shall govern. Because Customer controls the sessions used by users, if you have questions about specific session settings and privacy practices, please contact the customer whose session you are using or in whose session you are involved. Please also note that the Customer is the data controller for the processing of your session content under the EU General Data Protection Regulation (“GDPR”). ConWISE collects and processes the user’s content information exclusively on behalf of the customer.

If you are a trial user , ConWISE is responsible for the processing of your personal data according to the GDPR.

2.2. Legal Bases for Use of Information by Probe Users

Please note that the EU General Data Protection Regulation (“GDPR”) legal bases for using the information we collect through your use of the Platform as a trial user are as follows:

  • Where use of your information is necessary for us to perform our obligations under a contract we have with you (e.g. to comply with the Terms of Service).
  • When the use of your information is necessary for our legitimate interests or for the legitimate interests of others (e.g. to secure or operate our platform; prevent fraud; analyze and improve the use of our platform and for similar purposes).
  • When the use of your information is necessary to comply with a legal obligation.
  • When we have your consent to process data in a certain way.

2.3. Collection and Use of Information

Certain information, such as B. Customer login details are required to grant you access to the Platform and further information may be automatically collected when using the Platform.

  1. Session content for users .
    Session Content will be collected, used and shared by ConWISE in accordance with Customer’s instructions, including any applicable terms of Customer’s Agreement, or in accordance with applicable law. Customer establishes its own internal policies for storing, accessing, modifying, deleting, sharing and retaining Session Content. For example, a customer can provide or remove a user’s access to the platform, enable or disable third-party integrations, manage permissions, organize team affiliations, or share sessions. Please inquire with the customer about the specific policies and settings for session content that you provide when using the platform.
  2. Session Content for Trial Users .
    In the case of trial users, session content is collected, used and passed on by ConWISE in accordance with applicable law. The trial user can save, change or delete session content, but this can be restricted by ConWISE. It is also possible for ConWISE to delete session content after a certain period of time.
  3. Account Information .
    To set up your ConWISE account, you or the customer must provide us with basic information about you, including your name, address, telephone number, e-mail address and password. You may be given the opportunity to enter optional profile information. If you choose to provide payment information in connection with subscriptions, we use an outside company to collect payment information, billing address, and phone number. In this case, it is not ConWISE that stores your payment information, but rather the third-party provider on our behalf.
  4. Information about platform usage .
    As you use the Platform, we collect information about how you use and interact with it. Such information includes, among other things:
  • Device information – we may collect your MAC address and other unique device identifiers.
  • Log Files – When you use the Platform, information may be automatically recorded in server log files. These log files may contain information such as your web request, IP address, browser type and settings, referring/exit pages and URLs, number of clicks, date and time stamp information, language preferences, data from cookies and similar technologies, and other related information.
  • Location Information – we collect and process general information about the location of the device from which you access the Platform (e.g. approximate geographic position, which can be derived from an IP address).
  • Session usage metadata – when you interact with the platform, metadata is generated that provides high-level data (not content-related) about the way you work in your session. For example, we may record the number of sessions you work in; the processing time of sessions, the number of tasks assigned to you; the features of the platform you are using; the number of posts you make.     If you choose to use or connect to third-party integrations through the Platform, or if you are requested or authorized to do so by a customer, those third parties may provide us with access to additional information about your interaction with those services in connection with Enable and store your use of the Platform. 2.4. Use of Information

ConWISE may only use session content collected from and about users if it is necessary for the following:

  • To investigate when we have a good faith belief, or have received a complaint, that Session Content violates the Customer Agreement or our Terms of Service.

2.4.2. Account information, platform usage information, information from third-party integrations and other information

ConWISE may use these categories of information collected from and about users for the following purposes:

  • Maintaining, providing and improving service delivery and platform features.
  • Responding to your requests for information.
  • Prevention or resolution of technical or security-related problems and resolution of support requests.

2.5. Sharing Information

Subject to the applicable customer contract, we may share the information we collect from users as follows:

  • We may provide access to your information or share it with selected third parties who will only use this information to perform services on our behalf. These third parties perform a variety of services for us, including but not limited to sales, marketing, content and feature delivery, analytics, data storage, security, fraud prevention, and other services.
  • If ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the Platform and related services can continue to operate. In that case, the promises and commitments contained in this Privacy Policy will continue to apply to your information. If such transfer is subject to additional mandatory restrictions under applicable law, ConWISE will comply with them.
  • Please note that the session content that you submit via the Platform may be visible to other users in your session and within your organization (for users) or teams (for trial users).

2.6. Aggregated Anonymized Data

We may aggregate and/or anonymize information collected through the Platform so that such information can no longer be associated with you or your device (“Aggregated/Anonymized Information”). We may use aggregated/anonymized information for any purpose including, without limitation, research and analytics and to provide services to customers. In addition, this data can also be passed on to third parties, including partners, affiliated companies, service providers, etc. A time limit on use is not intended.

2.7. Combined Information

We may combine the information we collect through the Platform with information we receive from other online or offline sources and may use that combined information to provide the Service in accordance with this Privacy Policy.

2.8. Rights of data subjects as users

Please contact your administrator(s) to exercise any data subject rights you may have under applicable local law, including your ability to access, delete, rectify, transfer, or object under the GDPR.

3. Privacy Policy for Website Visitors

This section of the Privacy Policy only applies to visiting the Website.

ConWISE is responsible for the processing of your personal data in accordance with the EU General Data Protection Regulation (“GDPR”).

3.1. Collection and Use of Information from Website Visitors

When you use the websites, we collect the following information about you:
